List of Legal Requirements you Need to Consider Before Starting Your Business

In General, in most states and jurisdictions, it is unlawful for any person or business, to carry on any business, trade, profession, calling, occupation or gainful activity without one or more of the following Business License or Permit registrations:

• Business Fictitious Trade Name , Business Fictitious Trade Name ,

• Federal Tax Id Number Number,

• State Employer Number (EIN)/ employer identification number,

• Wholesaler's or Retailer's Buyer's License / resale license,

• Business license registration tax certificate and / or a

• Home-Based occupation permit.

1.  Business License or Permit

• All Businesses are  required to Get   a  Business License or Permit -   

  • (Note: A corporation, LLC or Business Fictitious Trade Name filing is NOT a Business License or Permit filing).

2.  Business Fictitious Trade Name Business Fictitious Trade Name

• Businesses using a  name other than the owner's name  are required to register a Business Fictitious Trade Name / Business Fictitious Trade Name Certificate.

3.  State Employer Number (EIN)/ Employer Identification Number EIN

• Businesses that are Employers are required to Get a  State Tax Id Number   (EIN) and a Federal Tax Id Number  (FEIN) 

  • NOTE: Sole owners can use a federal Tax Id Number to build business credit

4.  Seller's  Permit / Resale / Wholesaler's or Retailer's Buyer's License / Sales State Employer Number (EIN) Number

• Wholesalers, retailers of taxable goods / services require a  Wholesale License or otherwise called a Seller's  Permit

5.  Federal Tax Id Number Employer Identification Number FEIN

•  Corporations or LLCs, Employers, and, in some states,  those Businesses that are also getting a Wholesaler's or Retailer's Buyer's License are required to Get a Federal Tax Id Number  (FEIN)   and a  Business License or Permit .

6.  Corporation or Limited Liability Company

• A Corporation or LLC Filing will Eliminate Personal Legal and Financial Liability, save taxes, and protect your personal assets.

7.  Partnership Agreement

• Partnerships and LLCs should Have an Operating Agreement

Note that in most cases, you will be held liable for back taxes, be subjected to misdemeanor charges as well as be disrupted from normal business operations if you don't Get these legal documents.
